1. Who we are
We are NPIRE EXE LTD ("NPIRE", "we", "us", "our"), a company registered in England and Wales (company number 14348688), registered office 8 Martin Kinggett Gardens, Dagenham, England, RM9 6FD. You can contact us at support@npire-exe.com.
These Terms of Service ("Terms") apply to our website at https://www.npire-exe.co.uk (the "Site") and to our online services, such as accounts, cloud saves, leaderboards and support (together with the Site, the "Services"). By using the Services, you accept these Terms. If you do not accept them, please do not use the Services.
2. Our games
Our games and apps are licensed to you under our End User Licence Agreement ("EULA"). If these Terms and the EULA conflict on anything to do with a game, the EULA wins. Our Privacy Policy explains how we use personal data.
3. Using the Services
You must be at least 13 to use our online services yourself. If you are under 18, a parent or guardian should read these Terms with you. You agree to give accurate information and to use the Services lawfully.
4. Our content and intellectual property
We and our licensors own all rights in the Services and their content, including text, images, video, logos, game names, code and design. You may view the Site and share links to it. You may not copy, republish, sell or commercially use our content without our written permission, except for sharing official press material as intended or where the law allows (for example, quoting for criticism, review or news reporting).
NPIRE, NPIRE EXE, our logo and our game names are our trade marks or names. You may not use them in a way that suggests we endorse you or your product.
5. Things you must not do
break the law, or harass, abuse or harm others;
interfere with, overload or try to gain unauthorised access to the Services, our servers or other players' accounts;
introduce viruses or other harmful code;
use bots, scrapers, crawlers or other automated means to copy or collect content or data from the Services, other than standard search engine indexing;
decompile, reverse engineer or extract code from the Services, except as the law expressly allows;
impersonate NPIRE or anyone else.
6. Artificial intelligence and data mining
You must not use the Services or their content, including text, images, video, audio, code and game material, to train, fine-tune or improve any artificial intelligence or machine learning model, or to build datasets, without our written permission.
We expressly reserve all rights in the Services and their content against text and data mining, including under Article 4(3) of EU Directive 2019/790. This reservation does not stop search engines or AI assistants from reading and linking to our pages to answer people's questions about NPIRE and our games.
7. Content you send us
If you send us content (for example through a form, email or community feature), you keep your rights in it and give us a non-exclusive, royalty-free licence to use it to provide and improve the Services and to respond to you. If you send ideas or feedback, we may use them without paying you, and we are not obliged to use them.
8. Purchases
Purchases of our games and in-game items are made through the relevant store or platform, under its payment and refund terms and our EULA. If we sell anything directly on the Site, the order terms shown at checkout will also apply. Your statutory rights are not affected.
9. Links and third-party services
The Services may link to other websites and services (such as app stores, social media and Buy Me a Coffee). We do not control them and are not responsible for their content or practices.
10. Changes and availability
We may update, change or withdraw parts of the Services. We try to keep the Site available, but we cannot promise it will always be available or free of errors. Where a change materially affects online features of a game you paid for, our EULA explains what notice we will give.
11. Suspension and ending
You can stop using the Services at any time. We may suspend or end your access if you seriously or repeatedly break these Terms, if we must do so by law, or to protect other users or the Services. Where reasonable, we will tell you why.
12. Your rights and our responsibility
If you are a consumer, nothing in these Terms affects your legal rights, including under the Consumer Rights Act 2015.
We are responsible for loss or damage you suffer that is a foreseeable result of us breaking these Terms or failing to use reasonable care and skill. We are not responsible for loss that was not foreseeable or for business losses. If you use the Services for business purposes, our total liability to you is limited to the greater of the amount you paid us in the 12 months before the claim and £100.
We do not exclude or limit our liability where it would be unlawful to do so, including for death or personal injury caused by our negligence, or for fraud.
13. Complaints and disputes
If you have a problem, please contact us first at support@npire-exe.com so we can try to sort it out. These Terms are governed by the law of England and Wales, and you can bring claims in the courts of England and Wales. If you live in Scotland or Northern Ireland, you can also bring claims in your local courts. If you live in the European Union, you keep the protection of the mandatory consumer laws of your country and can bring claims in your local courts.
14. Changes to these Terms
We may update these Terms from time to time. The date at the top shows the latest version. If a change materially affects your rights, we will tell you on the Site or in our games before it takes effect.
15. General
If any part of these Terms is found unenforceable, the rest stays in force. If we do not enforce a right straight away, we can still enforce it later. Nobody other than you and us has rights under these Terms, except as stated in our EULA.
